Terms of Use

1. License and App Store terms

Subject to these Terms, the developer grants you a personal, limited, non-exclusive, non-transferable license to use Falcon on devices you own or control. The App is licensed, not sold.

For copies obtained through Apple’s App Store, Apple’s Standard Licensed Application End User License Agreement—or any custom EULA presented for Falcon through the App Store—and applicable App Store terms also apply. If these Terms conflict with non-waivable consumer rights or applicable store terms, those rights and terms control to the extent required by law.

2. Acceptable use

You may use Falcon only to test networks, systems, and devices that you own or have clear authorization to test, including SSH peers and devices that connect to Falcon’s local server.

You must not use Falcon to scan, stress, disrupt, overload, bypass access controls, or otherwise interfere with a third-party system without authorization. You are responsible for complying with applicable law, your network provider’s terms, and any rules set by the target operator.

3. Test traffic and data usage

Throughput testing can generate substantial traffic and may consume metered data, battery power, network capacity, or third-party resources. Review the duration, direction, parallel streams, and bitrate before starting a test. You are responsible for the traffic and costs caused by your configuration.

4. Public servers and external services

Falcon may provide a directory of public iPerf servers for convenience. These servers are operated by independent third parties and are not operated, controlled, or monitored by the developer. Their availability, performance, supported features, acceptable-use rules, and privacy practices may change without notice.

Use public servers at your own discretion, follow the operator’s restrictions, and do not transmit sensitive content. Links to Apple, GitHub, or other external services are governed by those services’ own terms and policies.

5. Falcon Pro purchase

Falcon Pro is offered as a one-time In-App Purchase, not a subscription. The price, included features, and availability are shown in the App and App Store at the time of purchase. Apple handles billing, taxes, purchase restoration, and refund requests under its terms. The developer does not process payment-card details.

6. Open-source components

Falcon incorporates open-source software, including iPerf3, iPerf2, Citadel, and swift-nio-ssh. Those components remain subject to their respective licenses. Notices and license texts are available in the App’s About screen.

7. Results, exports, and backups

Measurements can be affected by device hardware, wireless conditions, routing, competing traffic, server configuration, and protocol behavior. Results are informational and should not be treated as a guaranteed service-level measurement. You are responsible for exported files, shared result cards, and any backups you choose to create.

8. Disclaimer

To the maximum extent permitted by law, Falcon is provided “as is” and “as available,” without warranties of uninterrupted operation, error-free behavior, fitness for a particular purpose, or absolute measurement accuracy. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

9. Limitation of liability

To the maximum extent permitted by law, the developer is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use Falcon, including network interruption, data charges, lost data, device issues, or business loss. Nothing in these Terms excludes liability that cannot legally be excluded.

10. Termination

Your license ends automatically if you materially breach these Terms. You may stop using Falcon at any time by uninstalling it. Provisions that by their nature should survive termination—including ownership, disclaimers, and liability limits—will continue to apply.

11. Changes

These Terms may be updated as Falcon changes. The current version will be published here with a revised date. Material changes apply prospectively to the extent required by law.
